Acceptance of Terms

The terms of service you are reading (hereinafter referred to as the "Terms") constitute a legal agreement between Game Changer Athletic LLC (hereinafter referred to as "Game Changer Software" or "we") and you (hereinafter referred to as "you") regarding your use of Game Changer Software's social games and related services (including mobile applications and Game Changer Software branded websites) (hereinafter referred to as the "Services"). By accessing or using any Game Changer Software Services, you agree that you have read, understood, accepted, and agreed to be bound by these Terms.

This Service is intended only for individuals aged 13 and older for entertainment purposes. By using this Service, you represent that you are at least 13 years old. If you are between the ages of 13 and 18, you represent that your legal guardian has read and agreed to these Terms.

These Terms include the terms and conditions on this page, as well as the terms contained in the following additional policies, which are hereby incorporated by reference into these Terms. Please read these Terms (including the additional policies) carefully, as they will govern your use of the Services.

Modifications

Game Changer Software reserves the right to change, modify, add, or delete portions of these Terms at any time by posting revised Terms in the Services or within the Services. You are responsible for regularly reviewing these Terms. Your continued use of the Services after any changes or modifications indicates your acceptance of the revised Terms. If a change materially alters your rights or obligations under this Agreement, Game Changer Software will notify you of the change, for example, by sending an email to the address we have on record for you or by notifying you the next time you log in to the Services. Such changes will take effect on the earlier of (a) your actual knowledge of the change while using the Services or (b) thirty days after Game Changer Software posts the change in the Services. Additionally, any disputes arising under this Agreement will be resolved according to the Terms in effect at the time the dispute arises. You agree that Game Changer Software may change any part of the Services (including its content) at any time or discontinue the Services or any part thereof for any reason without notice to you and without liability.

If you violate these Terms at any time, Game Changer Software reserves the right to immediately terminate or suspend any or all accounts you have created using the Services. You agree that Game Changer Software is not required to provide any notice before terminating or suspending your account. Game Changer Software may, in its sole discretion, provide such notice. If you disagree with any part of these Terms at any time, your license to use the Services will terminate immediately, and you must cease using the Services.

Access to Services

By accessing or using the Services, including browsing any Game Changer Software website or accessing games, you accept and agree to these Terms. You warrant that you are at least thirteen years old, have not previously been suspended or terminated from using the Services, and are not prohibited from receiving products originating in the United States, including the Services or software. By accessing the Services through a social networking service (SNS), you authorize Game Changer Software to access and use any and all information related to providing the Services that you have configured such SNS to provide to third-party service providers, and to post notifications about your use of the Services to your account on the SNS.

Requirements for Using the Services

You agree to comply with the following requirements when using the Services:

If you are under 13 years old, you must not create an account or access the Services.

You should monitor your account to restrict access by minors and deny access to children under 13. You bear full responsibility for any unauthorized use of your account by minors. You are fully responsible for any actions taken by minors using your credit card or other payment methods.

You must not have more than one account on each platform or SNS at any time, and you must not use false identities or information or create accounts on behalf of others.

If you are a convicted sex offender, you must not create an account or use the Services.

If you have previously been removed or banned from playing any Game Changer Software games, you must not have an account or use the Services.

If you are located in a country subject to U.S. embargoes or are on the U.S. Treasury Department's Specially Designated Nationals list, you must not use the Services.

You must not sublicense, rent, lease, sell, trade, give away, bequeath, or otherwise transfer your account or any virtual items associated with your account (as defined below) without Game Changer Software’s written permission.

You must not access or use any account or virtual items that have been sublicensed, rented, leased, sold, traded, given away, bequeathed, or otherwise transferred from the original account creator without Game Changer Software’s permission.

License Information

Subject to your agreement and compliance with these Terms, Game Changer Software grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services solely for your personal, private, non-commercial entertainment purposes and not for any other purpose. You acknowledge that your license to use the Services is limited by these Terms, and if you violate or disagree with any part of these Terms at any time, your license to use the Services will terminate immediately, and you must cease using the Services. If the Services or any part thereof are deemed illegal under the laws of your jurisdiction, you are not authorized to use the Services and must stop using the Services.

Conduct and Usage Rules

You represent and warrant that you have all rights and authority to use the Services and to be bound by these Terms. You agree to comply fully with all applicable laws, regulations, statutes, and ordinances, as well as these Terms.

You agree not to defraud or attempt to defraud Game Changer Software or other users and not to engage in malicious conduct while using the Services. If Game Changer Software determines that you have engaged in malicious conduct that violates these Terms, or your behavior is inconsistent with reasonable community standards, Game Changer Software may, in its sole discretion, terminate your account and prohibit you from using the Services.

You agree to use the Services lawfully and to abide by the usage rules. To further clarify the foregoing, for example (but not limited to), you agree that you must not:

Create an account or access the Services if you are under 13 years old.

Upload, post, transmit, or otherwise disseminate any obscene, vulgar, pornographic, sexually explicit, or otherwise offensive or objectionable materials, as determined by a reasonable person.

Defame, ridicule, malign, mock, stalk, intimidate, threaten, harass, or abuse any person based on hatred, race, ethnicity, or any other reason.

Upload or transmit (or attempt to upload or transmit) any files that contain viruses, Trojan horses, worms, time bombs, cancelbots, corrupted files, or data, or any other similar software or programs that may damage the operation of the Services or the computers of other users.

Post, solicit, or transmit any commercial advertisements, including chain letters, junk mail, or repetitive messages (spam).

Infringe on any party's contractual, personal, intellectual property, or other rights, including using, uploading, transmitting, distributing, or otherwise providing any information or materials provided through the Services in a manner that infringes any copyright, trademark, patent, trade secret, or any other rights of any party (including privacy or publicity rights).

Create false identities, multiple identities, multiple user accounts, set up accounts on behalf of others, use bots or other automated software programs to defraud or otherwise violate these Terms and/or the terms of service of any third-party applications or social networks through which you access the Services.

Attempt to gain access to other members' passwords or other private information, including personal identification information (whether in text, images, or video form), identification documents, or financial information.

Intellectual Property (IP) Ownership

Game Changer Software reserves all rights to the materials of the Services. All content of the Services is protected by applicable copyright laws, trade dress laws, patent laws, trademark laws, international treaties, and other laws that protect intellectual property and related rights. If you provide any suggestions, feedback, ideas, or proposals regarding any current or future Game Changer Software products or services, including any feature developments, enhancements, or bug reports, you agree that such feedback is provided on a non-confidential basis, and you grant Game Changer Software and its successors and assigns an unlimited, worldwide, perpetual, irrevocable, transferable, sublicensable, royalty-free, fully paid-up right and license to use such feedback for any purpose and to practice any methods therein without payment, attribution, or other compensation to you or any other person.

Without the express prior written permission of Game Changer Software, you must not, nor may you instruct any other party to, modify, decompile, disassemble, reverse engineer, copy, transfer, create derivative works, rent, sublicense, distribute, copy, frame, republish, scrape, download, display, transmit, publish, lease, or sell any part of the Services for any purpose other than using the Services in accordance with these Terms. The foregoing does not apply to your own user content that you publish through the Services in accordance with these Terms. All other uses of copyrighted or trademarked materials, including any derivative uses, require the express prior written permission of Game Changer Software. Copying or redistributing materials that do not comply with these Terms is expressly prohibited and may result in the termination of your service account and severe civil and criminal penalties.

DMCA

Game Changer Software's policy is to respond to notices of alleged infringement that comply with the Digital Millennium Copyright Act (DMCA). Additionally, Game Changer Software will terminate accounts deemed to be "repeat infringers" without notice. If you are a copyright owner or an agent thereof and you believe that any content hosted by the Services infringes your copyright, you may submit a notice pursuant to the DMCA by providing the following information in writing to Game Changer Software's designated copyright agent:

A statement that the complaining party has a good faith belief that the use of the material in the manner complained of is unauthorized by the copyright owner, its agent, or the law (e.g., "I have a good faith belief that the use of the copyrighted material identified herein is not authorized by the copyright owner, its agent, or the law."); and

A statement that the information in the notice is accurate and, under penalty of perjury, the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed (e.g., "I swear, under penalty of perjury, that the information in this notice is accurate, and I am the copyright owner or am authorized to act on behalf of the copyright owner whose exclusive right is allegedly infringed.").
